1. Agreement to These Terms

These Terms of Service ("Terms") govern your use of this website and every experience, consultation, and service provided by AdrianCo LLC, doing business as Ascendify ("Ascendify," "we," "us," or "our"). "You" and "Client" refer to the individual or organization using the website or booking with us. By using the website, submitting a request, or securing a booking, you agree to these Terms.

Our Cancellation and Rescheduling Policy, Refund Policy, and Privacy Policy form part of these Terms.

2. Our Services

Ascendify provides live, curated experiences for organizations, including Attendee Attention Resets, Interactive Keynotes, conference packages, team building, leadership workshops, and consulting services. Each experience is customized during your consultation call. The scope, date, location, and fee we confirm in writing for your booking form part of your agreement with us.

3. Requests, Booking, and Payment

• Submitting a Request Your Date form does not reserve a date. Your date is reserved only after we confirm it in writing and receive payment in full or the required deposit.
• Prices are listed in U.S. dollars. For events outside our primary service areas, one flat travel fee tailored to your destination is confirmed when your date is approved.
• If you choose the deposit option, you authorize us to charge the remaining balance to the same payment method the week before your event, as described in our Cancellation and Rescheduling Policy.
• Payments are processed securely by our third-party payment processor. Payments for dates we have not confirmed may be declined and refunded in full.

4. Client Responsibilities

The Client is responsible for providing a clean, safe, and suitable space for each experience, with adequate floor space for movement where applicable, and for sharing accurate details about the venue, room configuration, schedule, and attendee count. Audiovisual needs are confirmed for each engagement during your consultation call, and Ascendify may provide audiovisual equipment for workshops and small group sessions where agreed in writing.

5. Participation and Health

Our experiences may include deep breathing exercises, guided meditation and visualization, movement, yoga, Pilates, mobility work, and our proprietary vibroacoustic experience. Every element is designed to be accessible, and participation is always voluntary.

• Our experiences are science-based performance optimization experiences, provided for educational purposes. They are not medical, psychological, or therapeutic treatment and do not replace advice from a qualified healthcare professional.
• Each participant is responsible for consulting a physician before taking part if they have a medical condition, injury, pregnancy, or other health concern, and for participating within their own comfort and ability.
• Participants may modify or skip any element at any time. Please let us know of any accommodation needs before your event so we can curate your experience accordingly.
• To the fullest extent permitted by law, you assume the risks associated with physical and mindfulness activities, and the Client is responsible for informing its attendees of these Terms.

6. Privacy and Discretion During Experiences

We never photograph, record, or share participants during any Ascendify experience. To protect the privacy of every participant and our proprietary methods, photography, audio or video recording, and live streaming of any Ascendify experience by attendees or the Client are not permitted without our prior written consent. NDAs are available on request. Our full commitment is described in our Privacy and Discretion Guarantee.

7. Intellectual Property

All content on this website and in our experiences is the exclusive property of Ascendify and is protected by United States and international copyright, trademark, and intellectual property laws. This includes all text, articles, FAQs, service names and descriptions, method descriptions, research summaries, session structures, sequences, scripts, workbooks, materials, graphics, photography, audio, video, and the design, layout, and arrangement of the website (together, "Ascendify Content").

Ascendify WellnessTM, AscendifyTM, and The Ascendify MethodTM are trademarks of AdrianCo LLC. You may not use any of our trademarks, or any confusingly similar name, in connection with any product, service, business, or domain without our prior written consent.

8. Prohibited Uses of Ascendify Content

Ascendify Content is provided for your personal, non-commercial review of our services. Without our prior written consent, you may not, in whole or in part:

• Copy, reproduce, republish, distribute, sell, license, or publicly display any Ascendify Content.
• Adapt, translate, paraphrase, summarize, rewrite, or create derivative or substantially similar works based on Ascendify Content, including website copy, photographs, images, video, service descriptions, FAQs, articles, and the structure or naming of our services and methods.
• Use screenshots, scraping, crawlers, automated tools, or artificial intelligence or large language model systems to extract, analyze, reproduce, or generate content from Ascendify Content, or use Ascendify Content to train, prompt, or fine-tune any such system.
• Teach, deliver, or market any experience, program, or workshop that reproduces or imitates The Ascendify Method or our session structures, sequences, or materials.
• Remove or alter any copyright, trademark, or other proprietary notice.

These restrictions apply regardless of whether content is altered, credited, or combined with other material.

9. Workbooks and Client Materials

Workbooks, handouts, and other materials we create for your engagement, including co-branded materials, remain the property of Ascendify and are protected by copyright. Upon payment, the Client receives a limited, non-transferable license to use them internally with the participants of its engagement. They may not be resold, republished, distributed outside your organization, or adapted without our prior written consent.

When you provide logos, trademarks, or other materials for co-branding, you grant Ascendify permission to use them solely to create and deliver your materials and experience, and you confirm that you have the right to do so.

10. Enforcement

Ascendify actively monitors for unauthorized use of Ascendify Content and our trademarks. Any unauthorized use automatically terminates your permission to use the website and may result in takedown notices to hosting providers, platforms, and search engines, and in legal action seeking injunctive relief, damages, profits, statutory damages where available, and attorneys’ fees and costs to the fullest extent permitted by law.

11. Reporting Infringement

If you believe Ascendify Content or our trademarks are being used without authorization, or if you believe content on our website infringes your rights, please contact us at info@ascendifywellness.com with a description of the material, its location, and your contact information.

12. Confidentiality

Ascendify keeps confidential all non-public business information you share with us, including information about your organization, strategy, attendees, logos, and materials, and uses it only to curate and deliver your experience. In turn, you agree to keep confidential our session materials, workbooks, proposals, and any pricing provided privately, and not to share them outside your organization without our prior written consent. These obligations do not apply to information that is publicly available or that must be disclosed by law.

13. Acceptable Use of the Website

You agree not to use the website for any unlawful purpose, submit false or misleading information, interfere with the website’s security or operation, or attempt to access any part of the website or our systems without authorization.

14. Third-Party Links

Our website links to third-party sites, such as research publications, reviews, and partner listings. We are not responsible for their content, policies, or practices.

15. Disclaimers

The website and its content are provided for general information. Research we reference is summarized for educational purposes, and individual results vary. To the fullest extent permitted by law, the website is provided "as is" without warranties of any kind, express or implied.

16. Limitation of Liability

To the fullest extent permitted by law, Ascendify will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue. Our total liability for any claim relating to an experience or these Terms will not exceed the amount you paid for the experience giving rise to the claim. This limit does not apply to amounts you owe us under your booking or our policies, or to claims arising from a breach of Sections 7 through 9 or Section 12.

17. Indemnification

You agree to indemnify and hold harmless Ascendify and its owner, employees, and contractors from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of Ascendify Content, or the acts of your attendees at an event you booked.

18. Independent Contractor

Ascendify provides its services as an independent business. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between Ascendify and the Client.

19. Circumstances Beyond Our Control

Neither party is responsible for delays or failures caused by events beyond its reasonable control, such as severe weather, natural disasters, public health emergencies, government action, or venue closures. Rescheduling in these circumstances is handled under our Cancellation and Rescheduling Policy.

20. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. Any dispute will be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction. Before filing any claim, both parties agree to first try to resolve the dispute through good-faith discussion.

21. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. You may not assign your booking or these Terms without our written consent. These Terms, together with the policies above and your written booking confirmation, are the entire agreement between you and Ascendify. Sections 7 through 12, 15 through 17, and 20 continue to apply after your engagement ends.

22. Changes to These Terms

We may update these Terms periodically. The version in effect when you secure your booking applies to that booking. Updates are posted on this page with a new "Last updated" date.
